Relationships are based on honesty and trust, and that’s why we work so well with our clients! That being said, all work needs guidance in the form of terms and conditions. Here are ours, drafted by a lawyer of course, but still in fairly straight-forward English. If you have any questions, just ask!
Terms and Conditions
The following Terms and Conditions of Service apply to all services and products provided by MetOne LTD (hereinafter referred to as MetOne Creative) and in the event of any dispute governed by the laws of England.
All work is carried out by MetOne Creative on the understanding that the client has agreed to our terms and conditions.
Copyright is retained by MetOne Creative, and designs, original artwork, electronic proofs, print ready PDFs and all other files created by MetOne Creative are protected by Copyright Law. These may not be reproduced, manipulated or re-worked for other purposes including editing. We retain the rights to make reproductions for our portfolio, samples, self promotion, professional competition and review and website. If a choice of designs are presented, and one is chosen for your project, all other designs remain property of MetOne Creative, unless specifically agreed in writing.
Designs created by MetOne Creative may not be reproduced, manipulated or re-worked for other purposes including editing. We retain the rights to make reproductions for our portfolio, samples, self promotion, professional competition and review and website. Concepts, art and work must not be shared with outside designers, businesses or agencies. This includes, but is not limited to, designs, concepts, sketches, electronic proof and photography.
Charges for services will be provided by MetOne Creative and set out in written estimate or quotation that is provided to the client. Acceptance of a quotation indicates acceptance of Terms and Conditions. Design is priced at an hourly rate, and is an estimate of time required to complete your project. This is subject to change and will be confirmed upon project completion.
Commencement of Work
No consultancy, creative or development work will commence until MetOne Creative has received written approval of the quotation (by hand or by email) and a minimum deposit of 50% of the agreed costs (unless otherwise agreed in writing). This ensures that MetOne Creative is fully equipped to provide the very highest levels of service and expertise, from project inception through to completion. This also applies if a project is delivered in ‘stages’, whereby a deposit will be required before proceeding to each new stage.
All prices are subject to VAT at 20%, and standard 30 days payment following invoicing if an account is held, and on receipt of goods if no account is held. Web design provided by MetOne Creative is subject to a 50% deposit of quotation to begin production, with remaining balance to be invoiced upon completion.
Payments are to be made by online transfer, credit or debit card.
Changes and Cancellations
The client agrees that changes required over and above the estimated work, or in addition to the agreed will be liable to a separate charge. The customer also agrees that MetOne Creative holds no responsibility for any amendments made by any third party, before or after a design is published.
The parties agree to the following conditions for cancellation:
- Termination prior to completion of the work – a pro-rata fee will be paid by the client based on specifications undertaken by MetOne Creative from the client.
- Termination after completion of all work but before printing – full fee will be paid by the client and any third party costs and expenses incurred to date.
- Termination after printing – full project fee specified in the contract, including print charge will be paid to MetOne Creative by the client including any additional time, expenses and or third party costs involved in the project.
Customers agree to allow MetOne Creative all necessary access to computer systems required in order to complete a web project, including read/write permissions, usernames and passwords.
Once the webpage is completed, MetOne Creative will provide the customer with the opportunity to review the site, with one set of minor changes included, within 14 days of publication. Minor changes include small text changes and small adjustments to placements. It does not include changes to images, colour schemes or any navigation features. Any minor changes should be notified to MetOne Creative by email. MetOne Creative will consider that the client has accepted the original draft, if no notification of changes are received in writing by the customer, within 14 days of the start of the review period.
MetOne Creative offers a limited hosting services through an outsourced virtual server.
We do not warrant access to our servers will be uninterrupted or error free but we shall use reasonable endeavours to keep downtime to a minimum..
All websites designed or developed by MetOne Creative will include a small “website by MetOne Creative” note in the footer, with a link to our website. In turn, we are happy to provide a reciprocal link to your webpage on our ‘Digital Work’ page on our website.
MetOne Creative will not include in its designs any text, images or other data which it deems to be immoral, offensive, obscene or illegal. All advertising material must conform to all standards laid down by all relevant advertising standards authorities.
MetOne Creative reserves the right to use the services of sub-contractors, agents, and supplies and any work, content, services, and usage is bound by their Terms and Conditions.
The placement of an order through MetOne Creative is deemed to be acceptable of these terms and conditions, which are freely available at Met1.co.uk.
